With little advance notice, the US Government has made significant changes to the Visa Waiver Program (VWP), that permits individuals who are citizens of 38 countries, including France, Australia and the UK, among others (see footnote), to enter the US without first obtaining a business or tourist visa. These changes are effective immediately.
Who is impacted by this?
(1) Citizens of VWP countries who have traveled to Iran, Iraq, Syria or Sudan since March 1, 2011; and
(2) Citizens of VWP countries who are dual nationals of (including those born in) Iraq, Iran, Syria or Sudan.
Who does this not apply to?
(1) Canadian citizens traveling to the US for business or pleasure; or
(2) Employees who are already working in the US under US work visas, such as L-1 or H-1B.
Another recent change is that all persons using VWP after April 1, 2016, must have electronic passports.
If you have registered for the Electronic System for Travel Authorization (ESTA) online registration, which is required in order to use the VWP and have traveled to one of the four listed countries or if you are a dual national of one of these countries, your ESTA registration will be invalidated. You may receive a notification from the US Government (Customs and Border Protection) that your ESTA registration is no longer valid, but even if you have not received such notice, you should apply for a B-1/B-2 visa at a US Consulate or Embassy as soon as possible.
